1. About these terms

1.1 This website, javeddaniel.com (the "Site"), is operated by Javed E. Daniel, Attorney-at-Law, of Barbados ("I", "me", "my").

1.2 These terms apply to anyone who visits or uses the Site. By using the Site you accept them. If you do not accept them, please do not use the Site.

2. No legal advice

2.1 The content of the Site, including the practice area pages and the publications, is general information about the law. It is not legal advice and must not be relied on as legal advice.

2.2 Whether and how the law applies to you depends on the facts of your situation. You should get advice on your own circumstances before acting, or deciding not to act, on anything you read here.

3. No attorney-client relationship

3.1 Using the Site, reading its content, or contacting me through it does not create an attorney-client relationship.

3.2 A relationship begins only when I have confirmed in writing that I can act for you, the terms of the engagement have been agreed, and any conflict of interest check has been completed. Until then I am under no duty to act for you or to take any step on your behalf, including a step needed to meet a deadline or limitation period.

4. Sending information to me

4.1 Please do not send confidential or sensitive details of a legal matter through the Site or by email until I have confirmed that I can act for you.

4.2 Information you send before then may be used to check for conflicts of interest. Sending it will not prevent me, or any firm I practise with, from acting for another person in the same or a related matter.

5. Personal site

5.1 This is my personal professional website. The views expressed on it are my own. They are not the views of any firm, chambers or organisation I am associated with, or have been associated with.

5.2 Where I practise with a firm or chambers, a matter I take on may be conducted through that firm or chambers and on its terms of engagement. I will tell you if that applies before any engagement is agreed.

6. Publications

6.1 Each publication on the Site states the law as I understood it on the date it was published. The law changes, and I do not undertake to update publications after that date.

6.2 Publications are commentary on the law in general. They are not a statement of how any court would decide a particular case.

7. Intellectual property

7.1 The content of the Site, including text, the "JD" monogram and other design elements, is my property or is used with permission, and is protected by copyright and other intellectual property rights. © Javed E. Daniel. All rights reserved.

7.2 You may view, print and download content for your own personal, non-commercial use. You may quote short extracts from publications if you credit me as the author and link to the source page.

7.3 You may not otherwise copy, reproduce, republish or adapt the content, or use my name, monogram or likeness in any way that suggests I endorse you or any product or service, without my written permission.

8. Links to other websites

8.1 The Site may link to other websites, including sources of legislation and case law. I do not control those websites and I am not responsible for their content, accuracy or availability. A link is not an endorsement.

9. Availability and accuracy

9.1 I take reasonable care over the Site, but it is provided "as is". I do not guarantee that it will be available at all times, free of errors, or free of viruses or other harmful code. You are responsible for protecting your own devices.

10. Limitation of liability

10.1 To the fullest extent permitted by law, I am not liable for any loss or damage arising from your use of the Site, your inability to use it, or your reliance on any of its content, whether in contract, tort (including negligence) or otherwise.

10.2 Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the law of Barbados.

11. Acceptable use

11.1 You must not use the Site for any unlawful purpose; attempt to gain unauthorised access to the Site or the systems that host it; interfere with its operation; or send unsolicited marketing, spam or harmful material through it.

12. Privacy

12.1 My Privacy Notice explains how I handle personal data collected through the Site.

13. Changes to these terms

13.1 I may change these terms at any time by publishing a new version on this page. The date at the top shows when they were last updated. The version in force when you use the Site is the one that applies.

14. Governing law and jurisdiction

14.1 These terms, and any dispute arising from them or from your use of the Site, are governed by the laws of Barbados.

14.2 The courts of Barbados have exclusive jurisdiction over any such dispute.
